These terms and conditions (the “Conditions”) together with our Privacy Policy and Returns Policy form a contractual agreement between a visitor or customer (“you”, “your”, “yourself”) to www.hamptonliving.co.uk (the “Website”) and Hampton Living (“we”, “us”, “our”) and your purchases from our Website. Please read them carefully as they contain important information.

GENERAL TERMS AND CONDITIONS

The Website is the ecommerce site owned and operated by Hampton Living, which is the business of sole trader Miss N Goode (from here referred to as “Hampton Living”).  When you visit or purchase from the Website you automatically agree to be bound by these Conditions, as well as other documents referred to in it, including, but not limited to our Privacy Policy and Returns Policy.  Please ensure you read these Conditions before placing an order.  These Conditions will be available on the Website on the About Us page and will be shown in the footer of the checkout page.  You may print a copy of these Conditions or save them to your computer for reference only.

We reserve the right to amend the Conditions at any time.  The current version of the Conditions were created on October 17th 2014.

 

1 The Contract between Hampton Living & Yourself

1.1    We must receive payment of the whole of the price for the goods that you order before your order can be accepted. 

1.2    Once payment has been received by us we will confirm your order and acceptance of it by sending an email you confirmation to the email address you provide at checkout or on your invoice. 

1.3    Our acceptance of your order brings into existence a legally binding contract between us.

 

2 Intellectual Property Rights

2.1    All rights, including design, copyright, information and intellectual property on the Website are owned by, or licensed to Hampton Living.  

2.2    Any use of this Website or its contents, including copying or storing it, or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. 

2.3    We strictly prohibit you from modifying, distributing, or reposting anything on this Website for any purpose, except where:

(a) You copy or print these Conditions for you own personal use to refer back to, with regards to your own personal use, or purchase from, the Website.

(b) You copy or print extracts from the Website with the sole purpose of showing a third party for their own personal use, with no commercial advantage or benefit in so doing.

If you do use the material under these conditions you must acknowledge us as the source of the material and you must inform the third party that they must comply with the conditions.

 

3 Accuracy of Content

3.1    We have taken care in the building of this website and in preparing all the content on it.  Prices quoted are correct at the time of publishing and care has been taken to ensure that all goods have been fairly described. 

3.2    Any weights, dimensions and capacities given about the goods are approximate only.  Colours displayed on our website in photographs of products may vary on different PCs, Macs and displays.

3.3    The content on the Website is provided for general information only and we make no warranties, either expressly or implied, as to the Website’s accuracy.

 

4 The Website and Changes to the Website

4.1    We reserve the right to update and change the Website and any content on it, at any time.  Please note that any of the content on the Website may be out of date at any given time and we are under no obligation to update it.

4.2    We do not guarantee that our Website, or any content on it, will be free from errors or omissions.

4.3    Your continued use of the Website after any changes shall be deemed as your acceptance of any such change.

4.4    We provide no guarantee that our Website will be secure or free from bugs or viruses, however we do take steps to avoid this occurring.  You are responsible for configuring your own technology to protect against such bugs and viruses.

4.5    You must not misuse our Website by knowingly introducing viruses, worms, trojans or any other material which is harmful or malicious. 

4.6    You must not try to gain unauthorised access to any part of our Website or information linked to it.

4.7    You should not commit any offence under the Computer Misuse Act 1990.

 

5 Making a Purchase and Availability

5.1    Making an online purchase at Hampton Living is easy, quick and secure and is available 24 hours a day, 7 days per week. Simply browse our online shop and add any items you wish to purchase to your shopping cart after confirming the quantity.

5.2    We are not liable for the Website going down due to any reason out of our control.  We do not guarantee that our Website, or any content on it, will always be available or uninterrupted.  We also reserve the right to remove, suspend discontinue, or change any part of, or all of, the Website at any time.  We will not be liable to you if for any reason our Website is unavailable at any time or for any period.

5.3    You are responsible for making all arrangements necessary for you to have access to our Website.  You are also responsible for ensuring that all persons who access our Website through your internet connection are aware of these Conditions and comply with them.

5.4    When you have finished your shopping and have checked your order, click on your shopping cart, select ‘checkout’ and fill out the few details needed to complete your order. Please ensure that all fields are completed, otherwise you will be unable to complete the checkout.

5.5    

(a) All orders are subject to acceptance and availability.  If the goods you would like to order are not available from stock, the website will clearly display the ‘sold out’ sign and it will not let you purchase them upon checkout.  

(b) You can email us at customerservice@hamptonliving.co.uk and we may be able to specially order the item for you or we can contact you by e-mail or phone to let you know when the product comes back in stock.   We can only specially order an item if it is in stock at our suppliers or if our suppliers intend to make more of the product.  

5.6    You must be 18 years of age to purchase from our website.

5.7    By purchasing from our Website you agree that you are the owner of the payment method used.

 

6 Acknowledgement and Acceptance of your Order

6.1    You will need to provide us with your e-mail address so that we can email you a confirmation of your order, your invoice and when your order has been shipped.      

6.2    An acceptance of your order will take place on despatch of the good(s) ordered.

 

7 Ordering Errors

7.1    You are able to correct errors on your order up to the point on which you click on ‘submit’ during the ordering process.

 

8 Price

8.1    The prices payable for goods that you order are as set out on our website and are in GB pounds sterling.  

8.2    All prices are correct at the time of publication

8.3    All prices are inclusive of VAT at the current rates and are correct at the time of entering information. 

8.4    Prices exclude delivery.

8.5    Wherever it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email, offer to sell you the goods of the specification and description at the price stated in the email and will state the period for which the offer or the price remains valid.

 

9 Payment Terms

9.1    Our Payment process is operated through Stripe via a secure server. Our Website has SSL protection (which you may relate to the lock symbol)  on the payment pages. All card information is encrypted using the latest secure technology and passed directly to Stripe for authorization. No credit card information is stored on the Hampton Living server at any time.    

9.2    We will charge your credit account for payment upon receipt of your order unless delivery cannot be fulfilled within 30 days. Please note that your payment transaction will appear as Hampton Living on your credit/debit card statement. 

9.3    Alternatively, payment by cheque or bank transfer is also accepted. Please contact us at customerservice@hamptonliving.co.uk or call us on 07515397956 for details on how to make payment this way.  All cheques must be cleared by the bank before the order can be dispatched.

9.4    An answering machine is available outside business hours, or if we are unable to receive the call: please leave your name and number and we will return your call as soon as possible.

9.5     We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the goods from your account then we can cancel the contract and/or suspend any further deliveries to you. This does not affect any other rights we may have.

 

10 Delivery charges

10.1    Delivery charges vary according to the type of goods ordered and cannot be refunded. They are set out clearly under the ‘Delivery’ section on our website.

10.2     We will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. A signature will be needed upon delivery, so please ensure someone will be available to sign for your items. 

10.3    We cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions (unless caused by our negligence). 

10.4    We will aim to deliver the goods by the date quoted for delivery, but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

10.5     You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.

 

11 Risk and Ownership

11.1    Risk of damage to, or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. 

11.2    You will only own the goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

 

12 Cancellation Rights

We hope that you will be delighted with your order, however there may be an occasion where you need an exchange or a refund. 

12.1     If you are a UK/EU consumer, you have the legal right to cancel your order within fourteen days following your receipt of the goods or the date on which we begin provision of the services.  Please see details on our returns policy.

12.2     

(a) Damaged or incorrectly supplied products: You should check all products you receive against your order in accordance with our returns policy, please see our returns policy section on our website. 

(b) If the products you receive are damaged, or incorrectly supplied, on delivery then you must note the details of any damage, or error in supply, on the delivery documentation and inform us (by post, phone or e-mail only) within fourteen days of delivery. 

(c) With regard to damaged items please inform us within forty eight hours, you will still have fourteen days to return the item.  Please send us a photograph of any damage within the forty eight hours.

(d) Where possible do not sign for an item that appears damaged upon delivery.          

(e) You must return the products to us as soon as possible (within fourteen days of receipt of your order) after first informing us that the products are damaged or have been incorrectly supplied. 

(f) Please note that we will not accept the return of any damaged or incorrectly supplied products where you fail to notify us of this within fourteen days of receiving them.

12.3     Other cancelled products: If you want to cancel products that are not damaged or incorrectly supplied, then you must inform us of this within fourteen days, starting the day after you receive the order. You must take reasonable care of the products, in accordance with our returns policy conditions, that you wish to cancel and not use them. Products should be returned at your cost within fourteen days of receipt of your order.

 

13 Cancellation by Us

13.1     We reserve the right to cancel the contract between us if:

(a) we have insufficient stock to deliver the goods you have ordered;

(b) one or more of the goods you ordered was listed at an incorrect price due to a typographical error, or an error in the pricing information received by us from our suppliers.

(c) any reasons beyond our control

13.2     If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible, but in any event within 30 days of your order. 

 

14 Liability

14.1     If you do not receive goods ordered within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing at our contact address: Hampton Living, 1 Chasefield, Park Road, Bowdon, Cheshire, WA14 3JR , or by email to: customerservice@hamptonliving.co.uk of the problem within 60 days of the date on which you ordered the goods (unless this is not reasonably practicable).        

14.2    If you notify a problem to us under this condition, our only obligation will be, at your option:

(a) to make good any shortage or non-delivery; 

(b) to replace or repair any goods that are damaged or defective; or 

(c) to refund to you the amount paid by you for the goods in question, in whatever way we choose.

Any liability will not exceed the the price of the product(s) purchased.

14.3    We are not liable for delay or failure to perform any obligations or products ordered by you, if the delay or failure was due to any reason beyond our reasonable control.

14.4     Both parties shall only be liable under this contract for losses, which are a reasonably foreseeable consequence of the relevant breach of contract

14.5     You must observe and comply with all applicable regulations and legislation, including obtaining all necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain of our goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import of the goods you purchase.

 14.6    We are not liable in contract, tort including without limitation negligence, pre-contract or other representations (other than misrepresentations that may be deemed negligent or fraudulent) or otherwise out of or in connection with the Conditions for any economic losses including without limitation loss of revenue, profit, contracts, business or savings; loss of goodwill or reputation; loss of data; loss of anticipated savings; any indirect or other losses suffered or incurred by any party arising out of or in connection with the provisions of the Conditions.

14.7     Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law, or other statutory rights, that may not be excluded, nor in any way to exclude, or limit our liability to you, for any death or personal injury resulting from our negligence. 

14.8    In addition you agree to indemnify, defend and hold us and our officers, directors, employees, agents and suppliers harmless immediately on demand from and against all claims, liabilities, damages, losses, costs and expenses including reasonable legal fees arising out of any breach of the Conditions by you or any other liabilities arising out of your use of the Website or by any other person accessing the Website

14.9    We are not responsible or liable for any links you may access via our Website.  We have no control or responsibility over the content of such links, or attached websites.  Their inclusion is not an endorsement nor affiliation with any website.

 

15 Notices

15.1    Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address at Hampton Living, 1 Chasefield, Park Road, Bowdon, Cheshire, WA14 3JR and all notices from us to you will be displayed on our website from to time.

 

16 Changes to Legal Notices

16.1    We reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

 

17 Law, Jurisdiction and Language

17.1    This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

 

18 Invalidity

18.1    If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

 

19 Privacy

19.1    You acknowledge and agree to be bound by the terms of our privacy policy which are clearly stated on our website under the ‘Privacy Policy’ section.

 

20 Third Party Rights

20.1    Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
